Abstract
The COVID-19 pandemic not only tested global healthcare systems but also challenged law enforcement, particularly in combating corruption. During the crisis, Indonesia and Malaysia faced different challenges in handling corruption cases, with their legal and institutional dynamics moving in opposite directions. This study compares the effectiveness of anti-corruption criminal laws in both countries during the pandemic, focusing on the role of anti-corruption agencies as the frontline of law enforcement. Using a doctrinal research approach, this study analyzes legislation, court rulings, and anti-corruption policies in Indonesia and Malaysia. The findings reveal a sharp contrast: while Malaysia's Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) [Malaysian Anti- Corruption Commission] leveraged the crisis to tighten oversight and enhance accountability, Indonesia's Komisi Pemberantasan Korupsi (KPK) [Corruption Eradication Commission] saw its authority weakened. This decline was linked to amendments to the KPK Law that eroded the agency’s independence, coupled with restrictions on investigative powers during the health emergency. The study concludes that the COVID-19 pandemic became a turning point that widened the gap in anti-corruption effectiveness between Indonesia and Malaysia. While Malaysia successfully utilized its legal framework to strengthen corruption prevention, Indonesia regressed into institutional weakening. Without structural reforms, Indonesia’s anti-corruption law enforcement risks falling further behind not only Malaysia but also global standards.
